This also includes any Claim that arises before you accept these Terms of Use, regardless of whether the previous version of the Terms of Use requires arbitration.

There is no judge or jury in the arbitration, and the review by a court of the arbitration award is limited. However, in individual cases an arbitrator may issue a ruling for the same damages and repairs as a court (including legal damages, attorneys’ fees and costs), and must follow and enforce these Terms of Use as if it were a court.

The arbitration will be administered by the International Court of Arbitration of Panama City, and will be resolved in accordance with the Conciliation and Arbitration Rules of the International Chamber of Commerce of Paris, France, whose rules are considered incorporated by reference to this clause and They are available at www.intracen.org. You can choose to have the arbitration conducted by telephone, based on written communications, or in person.

To object to the cancellation of a reservation or freeze or close an account, contact the JHM TOURS Customer Service.

The additional terms and conditions will apply to your reservation and to your purchase of goods and services related to the trip you select. Read these additional terms and conditions carefully. In particular, if you bought a ticket, be sure to read all the transport terms and conditions issued by the travel provider, which can be found on the provider’s website. You agree to comply with the purchase terms and conditions imposed by any provider you choose to purchase their services, including, among others, the payment of all amounts when they expire and compliance with the rules and restrictions of the provider regarding the availability and use of rates, products or services. The air fare is only guaranteed once you have completed the purchase and tickets have been issued. Airlines and other travel providers may change their prices without notice. We reserve the right to cancel your reservation if full payment is not received in a timely manner.

JHM TOURS can offer you the opportunity to book two simple tickets, instead of a round trip ticket. Combined single tickets can be a better flight option, since they are usually cheaper and can be combined, either on the same airline or on different ones. Unlike round-trip tickets, each single ticket is subject to its own rules, restrictions and charges. If one of these flights is affected by changes in the airline (e.g., cancellation or rescheduling) for which a customer has to make changes to the other flight, the customer will be responsible for covering the charges incurred for the realization of Flight changes not affected.

With regard to some low-cost airlines, the price of your flight was converted from a different currency with practical reasons to offer you an estimate of the purchase amount in your local currency. For this reason, when booking, the amount charged by the airline on your credit card may vary slightly due to fluctuations in the value of currencies. Travelers have different options that will help them find the hotel, flight, car rental, cruise or ideal activity. The “ranking” settings, located at the top of the page, allow travelers to sort search results according to their preferences, based on price, verified comment score or other criteria. The “filter” settings also allow travelers to include or exclude different options to suit their travel needs. If no option is selected, we will show you a range of relevant options in the search results, based on the criteria described below:

Lodging: Our default sort order reflects the relevance of the establishments within your search criteria, since we want to make sure that we can find the right offer for you quickly and easily. We measure relevance by taking into account factors such as the location of an establishment, its comments scores, the popularity of the establishment (determined according to how many travelers on our site make reservations at that establishment), the quality of the content provided by the establishment, and the competitiveness of the rates and availability of the establishment, all in comparison with other establishments that adapt to your selected search criteria. The compensation paid by an establishment for reservations made through our sites is also a factor for the relative classification of establishments with similar offers, based on the relevance factors described above. In our non-predetermined classifications (for example, if you choose to sort by price or by star category), we will order the establishments with similar results according to the factors described above.

Flights: Our default sort order is based on the lowest price. On the occasions when two flights have the same price, the shortest flight will be shown first.

Car rental: Our default sort order is established mainly by price, although we could also consider other relevant factors, such as popularity, customer reviews, the convenience of the place where it will be collected, and the type or category of car.

Cruise: Our default sort order is based on some relevant factors, such as evaluations of the cruise line, the ship, the departure port and the destination, as well as the price per day, the duration of the cruise and the period of reservation.

You acknowledge that JHM TOURS Companies previously negotiate certain rates with suppliers to facilitate reservations. You also recognize that JHM TOURS Companies provide you with services to facilitate such reservations in exchange for a fee (the “facilitation fee”). The rate shown on the website is a combination of the rate previously negotiated by JHM TOURS Companies and the facilitation fees withheld by JHM TOURS Companies for their services. You authorize JHM TOURS Companies to make reservations for the total reservation price, which includes the rate shown on the website, plus tax recovery charges, service charges and when applicable, taxes on JHM TOURS Business services. You accept that JHM TOURS Companies charge you the total reservation price on your credit card. After submitting your reservation request, you authorize JHM TOURS Companies to make reservations on your behalf, including making payment agreements with suppliers.

You acknowledge that, except as set forth below with respect to tax obligations on the amounts we withhold for our services, JHM TOURS Companies do not collect taxes by remittance to the applicable tax authorities. Tax recovery charges for prepaid transactions are a recovery of estimated taxes (e.g., sales and use, occupancy, room tax, excise tax, value added tax, etc.) that JHM TOURS Companies pay the provider for taxes owed on the rate. Suppliers bill JHM TOURS Companies for certain charges, including tax amounts. Suppliers are responsible for sending applicable taxes to the corresponding tax jurisdictions. The appropriate levies and tax rates vary greatly depending on the location. The actual amounts of taxes paid by JHM TOURS Companies to suppliers may be different from the amounts for tax recovery charges, depending on rates, taxability, etc. valid at the real time when our customers use the service. We retain service charges as additional compensation for making your travel reservation. RESERVATIONS: JHM TOURS will only accept reservations if they are made no less than 15 days in advance of the date on which the commencement of services is required. Reservations can be made directly by the client on the website https://jhm-tours.com or by email to info@jhm-tours.com

CONFIRMATIONS: JHM TOURS will make the confirmations directly on the website https://jhm-tours.com or by email to the email provided by the client, within 48 hours after receipt of the reservations. JHM TOURS will not be responsible for services not confirmed, or confirmed, but not paid in a timely manner, in accordance with the terms of this agreement.

CANCELLATIONS: The client will make the cancellations of services confirmed by email to info@jhm-tours.com. Restrictions and cancellation charges may apply depending on the service, according to the specific policies of the provider. Cancellation notice with a minimum of 24 hours prior to the start of the contracted service is required, unless otherwise provided in the specific terms and conditions of the contracted service. Penalty of 100% of the cost of services for No Show, applies if the client does not show up at the scheduled time for the start of services. The user will not be entitled to claim or refund.

You can cancel or change your hotel reservation paid in advance, but you will be charged the cancellation or change charge indicated in the rules and restrictions for the reservation of the reserved hotel. If you do not cancel or change your reservation before the period indicated in the cancellation policy applicable to the hotel in which you booked, which varies according to the hotel (usually 24 to 72 hours) before your arrival date, you will be subject to a charge equivalent to applicable nightly rates, tax recovery charges and service charges. If you do not show up on the first night of the reservation and plan to check-in for the subsequent nights of your reservation, you must confirm the changes to the reservation before the first night of the reservation to avoid your cancellation.

 

You agree to pay the cancellation or exchange charges you incur. In exceptional cases, some hotels do not allow changes or cancellations once the reservation is made, as indicated in the rules and restrictions for reservations. You agree to comply with the Terms of use imposed with respect to your hotel reservation paid in advance.

 

Taxes are applied on sales, use and / or local hotel occupancy in the amounts we charge for our services (service fee and / or facilitation fee) in certain jurisdictions. Actual tax amounts on our services may vary according to the rates in effect at the time of your stay at the hotel.

You cannot book more than eight (8) rooms online for the same hotel and the same dates of stay. If we determine that you booked more than eight rooms in total through independent reservations, we can cancel your reservations and charge you a cancellation fee, if applicable. If you paid with a non-refundable deposit, it will be lost. If you wish to book nine (9) rooms or more, you must contact the JHM TOURS group travel specialists (info@jhm-tours.com) or by phone at (507) 6080 6140, or complete the group travel form online. One of our group travel specialists will search for your application and will contact you to complete your reservation. You may be asked to sign a written contract and / or pay a non-refundable deposit.

Some hotel providers may ask you to present a credit card or a cash deposit when you check-in, in order to cover the additional expenses you have during your stay. This deposit is not related to any payment received by JHM TOURS for your hotel reservation.

You cannot make changes directly to a car rental reservation you have made online. However, some car rental reservations can be canceled online without penalty, then re-book the rental with the correct information. Before canceling your reservation, check if it is refundable or if there are cancellation penalties. Prepaid car rental reservations are non-refundable.

You can cancel most flights online, including flights booked with points. Before canceling, be sure to check the airline’s Rules and restrictions on your itinerary to see what the airline allows you to do and what charges they charge for flight cancellations.

Full service airlines: If you booked in the last 24 hours some airlines will allow you to cancel your trip at no cost. If you booked more than 24 hours ago, the cancellation charges of the airlines apply.

Low cost airlines: Low cost airlines prefer to take care of their own changes and cancellations. However, we can help you communicate with them.

Non-refundable rates: Although you will not get a refund if you cancel, you may get a credit from the airline to use later. If you get a credit, be sure to read how to book a flight with an airline credit.

Round flights consisting of two simple flights: Since each ticket is considered separate, be sure to cancel each of your single flights separately. If one of your flights is with a low-cost airline, you must contact the airline to cancel that flight.

If you missed or missed the outbound flight, the airline will cancel your return flight. Unless you have booked a round flight with two simple fares, since, in that case, tickets are considered separate.

Vacation packages: Some parts of your vacation package can be canceled online. There are no charges to cancel your vacation package, but the hotel, the car rental agency, the activity provider, or the airline may apply charges that we must charge you. If you cancel a part of the itinerary of your vacation package, this will not affect any other part.

If you cannot board your departure flight, the airline will automatically cancel your return flight, unless you have booked a round trip flight with two one-way fares. Requests for refunds due to a lost flight are subject to the airline’s penalties and restrictions.

With certain hotels, you can have the option of immediate online payment or subsequent payment at the hotel. If you select the “Immediate Online Payment” option, JHM TOURS will immediately charge you the amount on your credit card in US dollars. If you select the option “Payment at the Hotel”, the hotel will charge you the amount on your credit card in the local currency at the time of your stay. You should keep in mind that taxes and fees vary between the two payment options. Tax rates and the currency exchange rate may change over time between the reservation and the stay. JHM TOURS coupons can only be applied to “Instant Online Payment” reservations. All reservations paid with this modality are final and cannot be modified, refunded, exchanged, canceled or transferred to others. The amount shown will be debited to your credit card, even if you don’t use the reservation.

JHM TOURS can offer, when available, additional hotel reservation options with discounts on the website. These hotels, called hotels with an opaque rate of JHM TOURS, are different from other hotels offered on the website in several important ways. The name and exact address of the hotel are not shown until the reservation payment is made. All reservations are final and cannot be modified, refunded, exchanged, canceled or transferred to others. The amount shown will be debited to your credit card, even if the reservation is not used. The hotel will determine the type of room based on the number of guests provided at the time of booking. All reservations are for non-smoking rooms (subject to availability). The room allocation is determined during check-in, and improvements are not available. A maximum of six (6) rooms with an opaque rate of JHM TOURS can be booked at a time. All rooms with an opaque rate of JHM TOURS will be booked under the same name, and this guest must be present during check-in. JHM TOURS opaque rate hotels do not qualify for hotel or club loyalty programs. During check-in, guests must present a valid ID and a credit card in their name (the amount of available credit required varies by hotel). Debit cards may not be accepted. Payment is processed at the time of payment. When the travel provider processes the payment, it is processed in the country in which the travel provider is located.

It is possible that JHM TOURS or the travel provider will have to verify: (i) the validity of the payment card (by means of a nominal value charge that will be refunded in a few days or that will be deducted from the final payment to the travel provider) and (ii) the availability of funds on the payment card (to be confirmed by the bank issuing the credit card).

Some banks and credit card companies impose charges for international or cross-border operations. For example, if you make a reservation with a credit card issued in the US with a merchant located outside the US, it is likely that the bank will apply an international or cross-border transaction fee. Also, it is possible that your bank or card company considers the reservation of an international trip as an international transaction, since we can pass your credit card information to an international travel provider to apply the corresponding charges. Also, some banks and credit card companies impose charges for currency conversion. For example, if you make a reservation in a currency other than the currency of your credit card, the credit card company may convert the amount of the reservation to the currency of your credit card and charge you a fee for currency exchange. The bank will be the only one that can determine the currency exchange rate and the foreign transaction fee corresponding to the day the transaction is processed. The Points Program provider will deduct from the state of your Account the amount of points you decide to use to complete the purchase. ADDITIONAL TERMS: Purchases made with points are subject to the point-to-dollar conversion rate established by the Points Program provider. The Points Program provider has the right to modify the conversion rates from point to dollars at any time. Likewise, some point program providers may define a minimum amount of points that can be exchanged in each of the transactions. Additional terms and conditions may apply, which are available on the website of the corresponding Points Program provider.

You are responsible for making sure that you comply with the foreigner’s entry requirements and that your travel documents, such as passports and visas (for transit, for business, for tourists or any other) are in order and for complying with any other entry requirements for foreign.
